1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern the use of the DriveSooner service provided via drivesooner.co.uk ("DriveSooner", "we", "us" or "our"). By signing up for or using our driving test slot notification service ("Service"), you ("you" or "Customer") agree to be bound by these Terms. If you do not accept these Terms, you must not use the Service.
We reserve the right to update or modify these Terms by posting revisions on our website. Continued use of the Service after any changes constitutes your acceptance of the updated Terms.
Definitions
In these Terms:
- "DVSA" means the Driver and Vehicle Standards Agency (the UK government agency responsible for driving tests).
- "Service" refers to DriveSooner's driving test slot notification service, which manually checks for available earlier slots matching your preferences and sends you an alert when one is found.
- "Alert" means the SMS and email notification we send you when we detect a matching slot.
- "Official DVSA booking system" means the DVSA online service used by learner drivers to book, view, change, or cancel their own practical driving test.
- "Manage", "managing" or "booking-management action" means taking an action that creates, books, changes, amends, cancels, swaps, holds, reserves, resells, confirms, pays for, or otherwise alters a learner's DVSA driving test booking or appointment record.
You must be at least 17 years old to use this Service (or the applicable minimum driving age if higher). By accepting these Terms, you confirm that you meet this age requirement and that you have the legal capacity to enter into this agreement.
2. Service Description and User Responsibilities
2.1 Prerequisite: Existing DVSA Booking
Our Service is only available to customers who already have a practical driving test booked with the DVSA. You must have a valid current driving test booking to use the Service. If you do not have a test booked, you must first book one through the DVSA before using DriveSooner.
2.2 Information Required
At sign-up, you will need to provide:
- Your full name and contact details: a valid email address and mobile telephone number.
- Your preferences: the date range within which you can take an earlier test, and up to 3 preferred test centres. From 9 June 2026, DVSA rules require that any centre change is to one of the 3 nearest eligible centres to your current booked location. DriveSooner applies this rule to your alert preferences.
After payment, you will be asked to provide your driving licence number and either your theory test pass certificate number or your DVSA driving test booking reference. We require these to carry out a quick validation check that you hold an active DVSA practical driving test booking and to operate the notification service. We do not use these details to book, modify, change, amend, cancel, swap, hold, reserve, resell, or manage any driving test on your behalf or otherwise.
You provide these DVSA details voluntarily. You acknowledge that the DVSA booking platform has its own terms and conditions, and that providing DVSA booking details to a third-party service may be restricted by, or may place you in breach of, the DVSA's own platform terms. You are responsible for deciding whether to provide those details to us and for any consequences under the DVSA's terms. If you do not wish to provide those details, you should not use DriveSooner.
It is important that you provide correct information and keep it up to date. We rely on the details you give us to monitor for slots and to contact you. We accept no responsibility for losses or delays resulting from incorrect or incomplete information you supply.
2.3 Your Responsibility to Act
When we send you an alert, it is entirely your responsibility to log in to the official DVSA booking system and change your test yourself, if you wish to do so. We will not take any action on your behalf. The DVSA's booking system operates on a first-come-first-served basis, and we cannot hold or reserve any slot for you. A slot we alert you to may have been taken by the time you act.
2.4 No Multiple Services
You agree not to use any other driving test cancellation or slot notification services simultaneously with DriveSooner. Using multiple services at once can reduce the effectiveness of each service and may affect your ability to act quickly on alerts. If you use another service that interferes with ours, we will not be responsible for any reduced effectiveness, and any satisfaction commitments may not apply.
2.5 Keep Account Details Secure
If we provide you with an account on our website, you are responsible for keeping your login credentials confidential. Do not share your DriveSooner account with others. Each account is for one individual only (the licence holder named on the account).
2.6 Test Eligibility and Preparedness
It is your responsibility to be eligible and prepared for any driving test you book for yourself following one of our alerts. This includes arriving on time at the correct test centre with the required documents and a suitable vehicle.
DriveSooner is not responsible for any test you cannot attend or that is cancelled by the examiner due to your failure to meet DVSA requirements. We provide a notification service only; we do not provide driving instructors, vehicles, or insurance.
3. How the Service Works
3.1 Monitoring and Alerts
Once your order is set up, DriveSooner manually checks throughout the day for cancellation slots that match your preferences (date range, test centres, and any other criteria you specify). These checks are conducted by our team and are used only to identify possible earlier slots for notification purposes.
When we detect a matching slot, we send you an SMS and an email alert as quickly as possible. The alert will include the test date, time, and centre. It is then your responsibility to act on that alert through the official DVSA booking system and change your test yourself.
We never book, change, amend, cancel, swap, hold, reserve, resell, or manage a driving test. All booking-management activity on the DVSA booking system in relation to your test must be carried out by you directly.
DriveSooner does not use bots, scripts, browser automation, scraping tools, or automated tools to search or check the DVSA booking system, and does not use automated transaction tools to book, change, amend, cancel, swap, hold, reserve, resell, confirm, pay for, or otherwise manage driving tests. Any checking we carry out is conducted manually throughout the day, solely for validation and notification purposes, and does not perform any booking-management action on the DVSA system.
3.2 Service Completion
The Service is considered complete and fully delivered when we detect and send you an alert for a slot that matches your specified preferences. Our obligation is fulfilled at the point we send that alert, regardless of whether you are able to act on it, whether the slot is still available when you visit the official DVSA booking system, or whether you choose to change your test.
We are not responsible for what happens after an alert is sent. The availability of the slot once you visit the official DVSA booking system is outside our control.
3.3 No Guarantee of Availability, Timescale, or Result
We cannot guarantee that a slot we alert you about will still be available by the time you log in to the official DVSA booking system. Test cancellations are taken on a first-come-first-served basis and can disappear quickly. We also do not guarantee that we will find a slot within your specified date range; availability depends on cancellations released by other candidates, which is outside our control.
Any timescale, statistic, example, statement of average customer experience, or similar wording shown on our website, in marketing, or in customer communications is illustrative only. It describes previous or typical customer outcomes and does not create a promise, guarantee, warranty, assurance, or contractual obligation that we will find an earlier test for you within that timeframe, or at all. Each DVSA test centre is different, availability changes constantly, and some centres may have no suitable cancellations during your monitoring period.
DriveSooner accepts no liability if a slot is taken before you are able to act on an alert, or if no suitable slot becomes available during your monitoring period.
4. Payment, Fees, and Satisfaction Policy
4.1 Service Fee
You are required to pay the applicable service fee (as shown on our website) before the Service begins. All fees are in UK Pounds Sterling and include any applicable VAT. We reserve the right to change our pricing, but no price change will affect you after you have already paid for your current service period.
4.2 DVSA Fees
Our fee covers monitoring and notification only. It does not include the DVSA driving test fee, which you will have already paid when you made your original booking. Any costs associated with changing your test through DVSA are between you and the DVSA; we have no involvement in that transaction.
4.3 Service Completion
The Service is considered successfully delivered once we detect and send you an alert for a slot matching your criteria. Our obligation is fulfilled at that point, even if you miss the notification, the slot is taken before you act, or you decide you do not want to change your test.
4.4 Processing Fees
We reserve the right to deduct reasonable processing costs in cases where a refund may be applicable, for example to cover payment processing charges. Any such deduction would be disclosed at the time.
4.5 Satisfaction Policy
All paid DriveSooner plans include a satisfaction guarantee. If you are not satisfied with our service, we will work with you to find a suitable resolution. This may include extended monitoring, additional support, or other remedies at our discretion. This guarantee does not automatically entitle you to a refund, but we take customer satisfaction seriously and will not simply close the door on a complaint.
The Service is considered delivered once we send an alert for a matching slot. If we have sent such an alert, the core service has been provided. You may still raise a concern with us and we will consider it in good faith.
4.6 14-Day Cooling-Off and Service Commencement
Under UK consumer law (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013), you have the right to cancel your purchase within 14 days of the purchase date for a full refund, provided the Service has not yet begun.
DriveSooner's Service begins immediately after payment, as monitoring starts as soon as your preferences are set up. By signing up and paying, you acknowledge that we will begin providing the Service immediately and you agree that your 14-day cancellation right ends once the Service starts.
If you cancel within 14 days and we have not yet begun monitoring, we will provide a full refund. If monitoring has already started, we may deduct a pro-rated amount for the service provided up to the point of cancellation, to the extent permitted by law.
4.7 Chargebacks
We encourage you to contact us first if you have any concern about a payment. If you raise a chargeback with your bank or card issuer without first contacting us, and the chargeback is not justified, we reserve the right to charge an administrative fee of up to £25 to cover the costs we incur. This fee will be waived if the chargeback was caused by legitimate fraud or error beyond your control.
4.8 Service Duration
DriveSooner's service runs until either we send you an alert for a matching slot, or your original test date is reached, whichever comes first. After a first alert, monitoring continues so you can find further earlier slots if needed, until your current test date arrives.
5. Communications and Notifications
5.1 Method of Contact
By using the Service, you agree that DriveSooner may contact you via the email address and mobile number you provided. This includes sending SMS and email alerts about available slots and other essential service updates.
5.2 Notification Delivery Disclaimer
DriveSooner cannot guarantee the successful delivery of any SMS or email alert. Delivery depends on third-party networks and email providers, which are outside our control. Messages can be delayed or fail due to network issues, coverage problems, spam filters, or other technical faults.
We are not liable for missed slot opportunities if a notification is delayed, undelivered, or not seen by you.
5.3 Your Responsibilities for Alerts
It is your responsibility to be in a position to receive and act on our notifications promptly.
Device settings: Make sure your phone can receive our messages. Do not block our number or email address, and avoid leaving your phone on silent or Do Not Disturb if you want to catch alerts quickly.
Contact information: Keep your email address and mobile number up to date on your account. We are not responsible for notifications sent to outdated details because you did not update them.
Spam and junk folders: Check your spam folder periodically and mark our emails as not spam if needed.
Acting quickly: Slots go quickly. Once you receive an alert, log in to the official DVSA booking system as soon as you can. We have no ability to hold a slot for you and accept no liability for slots taken while you are deciding.
5.4 Notification Considered Sent
We consider a notification delivered once we have sent it to the contact details you provided. We are not liable for any loss caused by your failure to receive, read, or act on a notification.
6. No Affiliation with DVSA
6.1 Independent Third-Party Status
DriveSooner is an independent third-party service. We are not associated with, affiliated with, endorsed by, or connected to the DVSA, GOV.UK, or any UK government department or agency.
Our Service manually checks for possible earlier slot availability and sends you alerts. We act solely as a notification service. We do not act as your agent in relation to your driving test booking. We do not perform any booking-management action on your behalf, and we do not submit, confirm, pay for, amend, cancel, or otherwise alter your DVSA booking.
You remain the only person responsible for your DVSA booking. We do not have authority to act for you, and you do not appoint us as your agent, representative, proxy, or delegate for the purpose of booking, changing, cancelling, swapping, holding, reserving, or reselling a driving test.
6.2 DVSA Regulations
From 12 May 2026, SI 2026/326 makes it against the law for third parties to book, change, cancel, swap, or otherwise manage driving tests on behalf of learners. DriveSooner operates as a notification-only service and does not carry out any of those activities. For clarity, DriveSooner treats "managing" a booking as making, submitting, confirming, paying for, changing, amending, cancelling, swapping, holding, reserving, reselling, or otherwise altering a learner's DVSA appointment record. All changes to DVSA bookings must be made by you directly through the official DVSA booking system.
Our compliance position is that DriveSooner does not book tests, does not manage bookings, does not alter learner appointments, does not swap appointments between learners, does not hold or reserve appointments, and does not resell appointments. We manually check for possible availability and provide information alerts only. If you choose to act on an alert, you must do so yourself through the official DVSA booking process.
6.3 No Special Access or Preferential Treatment
DriveSooner does not have any special access to or influence over the DVSA's availability of test slots. Our advantage is manual checking throughout the day and quick alerting, not any preferential access, automated access, or ability to hold slots. All driving test candidates have access to the same pool of cancellation slots.
6.4 Your Right to Self-Manage
You understand that you could check for driving test cancellations yourself on the official DVSA website at no additional cost. Our Service is offered purely for your convenience, to save you the time and effort of checking manually. You are paying for our checking and alert service.

6.5 DVSA Policies and Changes
Tests obtained as a result of acting on our alerts are subject to DVSA's own rules and policies. If the DVSA cancels or changes your test for reasons on their side, that is beyond our control and we are not liable.
DriveSooner reserves the right to modify, suspend, or discontinue the Service at any time in response to changes in DVSA policies, regulations, or legal requirements. In such circumstances, refunds will be handled in accordance with Section 4 of these Terms.
7. Changes Due to DVSA Regulatory Changes (May 2026)
From 12 May 2026, SI 2026/326 makes it against the law for third parties to book, change, cancel, swap, or manage driving tests on behalf of learners. In response, DriveSooner has updated all active orders to notification-only mode.
This change was made in accordance with both the new regulation and our existing Terms, which reserve the right to modify or change plan types in response to regulatory or DVSA requirements (see Section 9.2 and the transitional provisions in Section 11).
Customers who previously held orders under an earlier service model will continue to receive full slot checking and will continue to receive SMS and email alerts when a matching slot is detected. Monitoring is active. You must log in to the official DVSA booking system yourself to act on any alert we send. DriveSooner does not and will not take any action on the DVSA booking system on your behalf.

8. Data Protection and Privacy
8.1 Data We Collect and How We Use It
DriveSooner is committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
The personal data we collect includes your name, contact details (email and phone), driving licence number, DVSA booking reference or theory test pass certificate number, and your preferences and settings. The DVSA details you provide after payment are used solely to validate that you hold an active DVSA practical driving test booking and to operate the notification service. We do not use them to access, modify, or interact with the DVSA booking system on your behalf for any booking-management purpose.
You acknowledge that your DVSA details are not required by us so that we can book, change, amend, cancel, swap, hold, reserve, resell, or otherwise manage a driving test. They are requested only to confirm that you have an existing DVSA test booking and to support the notification service.
8.2 Data Security
We implement appropriate technical and organisational measures to protect your personal data, including encryption of sensitive fields, secure transmission protocols, and access-controlled servers. No method of internet transmission is 100% secure, and you transmit information to us at your own risk, but we take our data security obligations seriously.
8.3 Data Retention
Your data will be stored for the duration of your use of the Service and for a reasonable period afterwards for legal and administrative purposes. You may request deletion at any time, subject to our legal obligations to retain certain records.
8.4 Your Rights
You have rights under UK GDPR, including the right to access the data we hold, to correct inaccuracies, and in certain cases, to have your data erased. Contact us at any time to exercise these rights. For full details, please read our Privacy Policy.
9. Disclaimers and Limitation of Liability
9.1 No Warranty for Service Outcomes
DriveSooner aims to improve your chances of finding an earlier test date, but we do not guarantee that a matching slot will become available or that you will be able to secure it. The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the fullest extent permitted by law.
For clarity, no estimate, average, success rate, customer example, or statement about how quickly other customers may have found an earlier test should be interpreted as a promise that you personally will receive an alert, secure an earlier test, or receive a result within any stated period. Your result depends on DVSA availability, your chosen test centres, your date and time preferences, and how quickly you act on any alert.
9.2 Limitation of Liability
To the extent permitted by law, DriveSooner and its directors, officers, employees, agents, and partners shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with your use of the Service or these Terms. In all cases, our total aggregate liability to you is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.
9.3 Non-Excludable Liabilities
Nothing in these Terms excludes or limits liability that cannot be excluded by law. We do not exclude liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
10. General Provisions
10.1 Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. By using the Service, you submit to the exclusive jurisdiction of the English courts.
10.2 Changes to Terms
DriveSooner may amend these Terms from time to time, including in response to regulatory or DVSA changes. We will post the updated version on our website with a new "Last Updated" date. For significant changes, we will take reasonable steps to notify active users. Continued use of the Service after changes are posted means you accept the revised Terms.
10.3 Entire Agreement
These Terms, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and DriveSooner regarding the Service.

11. Transitional Provisions
11.1 Changes from 13 March 2026
On 13 March 2026, we simplified our service offering from multiple plan tiers (Lite, Premium, Premium Plus) to a single plan. These changes apply only to orders placed on or after 13 March 2026.
If you purchased a plan before 13 March 2026, that plan remains in effect under the terms that were in force at the time of purchase. Your plan type, features, test centre limits, and notification settings continue unchanged for the duration of your service. No action is required.
11.2 Changes from 14 May 2026 (Regulatory)
From 14 May 2026, all active orders have been updated to notification-only mode in response to SI 2026/326. This change was made under the right reserved in these Terms to modify plan types in response to regulatory requirements. Full details are in Section 7 above.
The one-time service fee is non-refundable once the checking service has commenced.
11.3 Changes from 14 May 2026 (Pricing and Centre Rules)
From 14 May 2026, the following further changes apply to all new orders:
- Single plan fee: The service is offered at a one-time payment of £12.99. No add-on purchases for additional test centres are available. Up to 3 eligible test centres are included.
- DVSA nearest-centre rule: From 9 June 2026, DVSA rules (SI 2026/326) require that any change of test centre is to one of the 3 nearest eligible centres to your current booked location. DriveSooner applies this rule to your alert preferences. The checkout requires you to confirm your current booked test centre first; the system then presents only the centres you are eligible to move to.
- No extra-centre add-ons: Additional test centre monitoring beyond the included 3 centres is no longer offered or sold. Previous orders that included paid add-on centre slots continue to be honoured for the duration of those orders.
12. Final Acknowledgement
By using DriveSooner's Service, you confirm that you:
- Understand the service: DriveSooner is a notification-only service. We manually check for available slots and alert you. We do not book, change, amend, cancel, swap, hold, reserve, resell, or manage any driving test. You must take any action yourself through the official DVSA booking system.
- Provided your details voluntarily: You have willingly provided your personal data, including your driving licence number and booking reference or theory test certificate number. These are used only to validate your active DVSA booking and to operate the notification service.
- Accept responsibility for DVSA platform terms: You understand that the DVSA booking platform has its own terms and that voluntarily providing DVSA booking details to DriveSooner may be restricted by, or may breach, those DVSA terms. You accept responsibility for your decision to provide those details.
- Understand the DVSA's position: The DVSA recommends that candidates manage their own bookings directly through the official DVSA system. DriveSooner is not affiliated with, endorsed by, or connected to the DVSA, GOV.UK, or any UK government body.
- Accept responsibility for acting on alerts: It is your responsibility to act promptly on any alert we send and to log in to the official DVSA booking system yourself to change your test. We are not responsible if a slot is taken before you are able to act, and we cannot hold or reserve any slot for you.
- Accept the regulatory position: From 12 May 2026, SI 2026/326 prohibits third parties from booking or managing driving tests on behalf of learners. DriveSooner complies with this regulation and operates as a notification-only service.
- Understand our no-automation and no-management position: DriveSooner does not use bots, scripts, browser automation, scraping tools, or automated tools to search or check the DVSA booking system, and does not use automated transaction tools to book, change, amend, cancel, swap, hold, reserve, resell, confirm, pay for, or otherwise manage any driving test. DriveSooner does not act as your agent, representative, proxy, or delegate for DVSA booking purposes.
- Consent to the following: "I understand DriveSooner is a notification-only service. DriveSooner will not book, change, amend, cancel, swap, hold, reserve, resell, or manage a driving test for me. I must complete any action myself through the official DVSA booking system."
By creating an account, making a payment, or otherwise using DriveSooner's Service, you confirm that you have read and understood these Terms and Conditions and agree to be legally bound by them. If you do not agree, you must not use the Service.
